Introduction
Welcome to FamilySpace ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the FamilySpace mobile application (the "App") and any related services.
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
1. Description of Service
FamilySpace is a platform designed to help families connect, share memories, build family trees, and communicate and share information within designated family groups. The App provides features such as timeline posts, photo sharing, family mapping, and notifications.
2. Eligibility and User Accounts
2.1 Eligibility
You must be at least 13 years old to create an account. By using the App, you represent and warrant that you meet this age requirement. If you are a parent or guardian, you may create profiles for children under 13 within your Family Space network, taking full responsibility for their information.
2.2 Account Creation and Security
To use certain features of the App, you must register for an account (e.g., via Google Sign-In). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. User-Generated Content
3.1 Content Ownership
You retain all ownership rights to the photos, text, and other materials you upload, post, or share on the App ("User Content"). We do not claim ownership of your User Content.
3.2 License to FamilySpace
By submitting User Content to the App, you grant us a royalty-free, non-exclusive license to use, store, display, reproduce, modify, and distribute your User Content solely for operating, maintaining, improving, and providing the App.
3.3 Shared Family Content Persistence
Content shared within a Family Space may remain accessible to authorized family members even if the original contributor leaves the Family Space or deletes their account, where reasonably necessary to preserve shared family history, memories, and relationships.
3.4 Responsibility for Content and Permissions
You are solely responsible for your User Content. You represent and warrant that you have all necessary rights, permissions, and authority to upload content relating to yourself and any other individual referenced in such content.
3.5 Data Availability
While we make reasonable efforts to maintain the availability and integrity of user content, FamilySpace does not guarantee that any content, family-tree information, photographs, or records will never be lost, corrupted, or unavailable. Users are encouraged to maintain their own backups of important information.
4. Family Tree Information
Family tree information may be contributed, edited, or maintained by multiple authorized family members. FamilySpace does not guarantee the accuracy, completeness, or historical correctness of any family relationship, date, record, or family-tree information submitted by users.
5. Family Disputes
FamilySpace acts solely as a platform for storing and sharing family-related information. We are not responsible for disputes, disagreements, inaccuracies, or conflicts arising between users regarding family relationships, family history, photographs, memories, or other shared content.
6. Acceptable Use Policy
You agree not to use the App to:
- Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.
- Impersonate any person or entity or falsely state your affiliation with a person or entity.
- Upload, post, or transmit any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of the App or any related infrastructure.
- Attempt to gain unauthorized access to the App, other users' accounts, or our computer systems or networks.
- Scrape, data mine, or extract data from the App without our express written permission.
7. Advertisements and Promotions
The App may contain advertisements and promotions. In consideration for FamilySpace granting you access to and use of the App, you agree that we may place such advertising on the App or in connection with the display of content or information from the App, whether submitted by you or others.
Your correspondence or business dealings with advertisers found on or through the App are solely between you and such advertisers. We are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.
8. Service Changes
FamilySpace is an evolving service. We may add, modify, suspend, or discontinue features, functionality, or portions of the App at any time.
9. Intellectual Property Rights
Except for User Content, the App and its original content, features, and functionality (including but not limited to all information, software, text, displays, images, design, and arrangement thereof) are owned by FamilySpace, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
10. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranty that (i) the App will meet your requirements, (ii) the App will be uninterrupted, timely, secure, or error-free, or (iii) the results that may be obtained from the use of the App will be accurate or reliable.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAMILYSPACE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
To the fullest extent permitted by law, the total liability of FamilySpace arising from or related to the App shall not exceed the greater of (a) INR 1,000 or (b) any amount paid by you to FamilySpace during the twelve months preceding the claim.
12. Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
Upon termination, your right to use the App will immediately cease. Users may request account deletion via our Account Deletion page.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
